The trinity of failures

According to a recent study, employee surveillance is rampant in today’s corporate work environment. This study documents how, often under the pretense of cybersecurity or risk analysis (sort of like academic publishers, actually), companies analyze the behavioral data they collect from their employees to help them make “evidence-led”, i.e., algorithmic employment decisions.

Flashback: The neurobiology of self-learning

This morning I was reminded of the age of some of the technology we’re using. Hyperlinks were developed at Stanford University and first demonstrated by their inventor Douglas Engelbart (using the first mouse) in 1968:  On Tuesday, Douglas Engelbart died, even before the scholarly literature was able to fully implement the technology he invented, 45 years and counting.

The recent publication of the “Ten Principles of Plan S” has sparked numerous discussions among which one of several recurring themes was academic freedom. The cause for these discussions is the insistence of the funders supporting Plan S that their grant recipients only publish in certain venues under certain liberal licensing schemes.

Does academic freedom entail exemption from spending rules?

Over the last ten years, scientific funding agencies across the globe have implemented policies which force their grant recipients to behave in a compliant way. For instance, the NIH OA policy mandates that research articles describing research they funded must be available via PubMedCentral within 12 months of publication. Other funders and also some institutions have implemented various policies with similar mandates.

Arguably, there is little that could be more decisive for the career of a scientist than publishing a paper in one of the most high-profile journals such as

. After all, in this competitive and highly specialized days, where a scientist is published all too often is more important than what they have published.

How Nature Magazine consistently prefers anecdote over data

The recent call for a GlamMag boycott by Nobel laureate Randy Shekman made a lot of headlines, but will likely have no effect whatsoever. For one, the call for boycott isn’t even close in scale to “the cost of knowledge” boycott against Elsevier and even that drew less than 15,000 measly signatures, a drop in the bucket with 970,000 board members, reviewers and authors working for Elsevier largely for free.

In the last “Science Weekly” podcast from the Guardian, the topic was retractions.  At about 20:29 into the episode, Hannah Devlin asked, whether the reason ‘top’ journals retract more articles may be because of increased scrutiny there. The underlying assumption is very reasonable, as many more eyes see each paper in such journals and the motivation to shoot down such high-profile papers might also be higher.

There are those who demand journal peer-review be paid extra on top of academic salaries. Let’s have a look at the financials of that proposal. The article linked above confirms common rates of academic consulting fees, i.e., anything between US$100 per hour for graduate students and US$350 per hour for faculty. Taking a conservative US$200 as an easy, lower-bound estimate for, say, a post-doc hour seems to cover most cases.

No matter how well-intended (and we all know to which place the road leads that is paved with good intentions!), transformative agreements (such as DEAL in Germany) are generally the wrong tool at the wrong time for making publicly funded science accessible to the public.

Booming university administrations

I really loathe reviewing for GlamMagz for two main reasons. For one, it’s hard to remain neutral: publication of a paper in my field in such a journal is beneficial both for the field and for the young people who are authors on this paper. Second, the demands of some of my colleagues so often make my blood boil. At that point I’m very happy these reviews are anonymous and I really don’t want to know the names of these colleagues.

Figures and legends occupy one virtual desktop and the text another. In this way, I can actually review on-screen, but it is one heck of a work-around and by no means convenient.

published a news story (not a peer-reviewed paper) by Gonzo-Scientist John Bohannon on a sting operation in which a journalist submitted a bogus manuscript to 304 open access journals (observe that no toll access control group was used).

For our course this year I was planning a standard neurogenetic experiment. I hadn’t ever done this experiment in a course, yet, just two weeks ago I tried it once myself, with an N=1. The students would get two groups of

Whither now, Open Access?

On May 23, the Council of the EU adopted a set of conclusions on scholarly publishing that, if followed through, would spell the end for academic publishers and scholarly journals as we know them. The content was simple enough: Bohannon picked a swath of largely fake journals, submitted fake manuscripts and boasted that more than 60% of his submissions were accepted.

In our new lab here in Regensburg, we are currently re-establishing the method of confocal microscopy. To start with, we used the fly lines which show a defect in the temporal structure of their spontaneous behavior (a project of one of our graduate students). this fly line uses two transgenic constructs (c105 and c232) to drive expression in specified neurons in the fly brain, i.e., the merged expression patterns of c105 and c232.

Looking for a PhD student

There have been many discussions about the march for science, pro and con. Some of them have made me doubt the utility of the march, some have made me fear unintended consequences, again others seemed tangential and petty. In these past months, I have struggled to articulate my own reasons why I feel the urge to march for science. Today, I start to see two main reasons to march for science.

This is an easy calculation: for each subscription article, we pay on average US$5000. A publicly accessible article in one of SciELO’s 900 journals costs only US$90 on average. Subtracting about 35% in publisher profits, the remaining difference between legacy and SciELO costs amount to US$3160 per article.

Over the last few months, there has been a lot of talk about so-called “predatory publishers”, i.e., those corporations which publish journals, some or all of  which purport to peer-review submitted articles, but publish articles for a fee without actual peer-review. The origin of the discussion can be traced to a list of such publishers hosted by librarian Jeffrey Beall.

Thinking more generally about the ["Recursive Fury"
debacle](https://bjoern.brembs.net/2014/04/resigning-from-frontiers),
something struck me as somewhat of an eye opener: the lack of support
for the authors by Frontiers and the demonstrative support by their
institution, UWA (posting the [retracted
article](https://websites.psychology.uwa.edu.au/labs/cogscience/Publications/LskyetalRecursiveFury4UWA.pdf)).
Even though this might be the first time a scholarly journal caved in to
legal pressure from anti-science groups, it should perhaps come as no
surprise. Ugo Bardi made a very valid point when he [recently
wrote](https://cassandralegacy.blogspot.it/2014/04/recursive-fury-reasons-of-frontiers.htmlhttps://):

> The problem, here, is \[...\] that we are stuck with a century old
> model of communication: expensive and ineffective and, worse, easily
> subverted by special interest groups

I disagree with his suspicion that Frontiers is a Ponzi scheme, as I
quite like the federated structure of the enterprise: we are thousands
of scientists and our work needs to be reviewed by thousands of
scientists. Any system we might come up with for scholarly communication
will, by necessity, be gigantic. But his insight quoted above really
deserves special attention and ought to be a thought provoker for
anybody in our business.

Any publisher always has an inherent conflict of interest: whether it is
the GlamMag hyping cold fusion, stem cells or the latest flashy social
psychology experiment to sell subscriptions, or a fledgling start-up
that sees their venture going down a legal drain or the idealistic
non-profit trying to get some more papers to hire one more developer for
the next great innovation: for all of them, the financial viability of
the enterprise comes before science. This conflict of interest is
usually not a major issue, but does come up enough to make me worry if
this is really a good idea -- especially in this day and age, when
digital publications cost virtually nothing.

As mentioned above, our own institutions obviously do not have this
conflict of interest, on the contrary, they are the reasons for the
existence of professional scientists. They can host our papers, when
publishers, even the 'good guys' like Frontiers, cannot.

Interestingly, just a few weeks earlier, Richard Poynder, after many
years of covering the open access movement, had already gotten me
started thinking along those lines,

Another piece of evidence of these conflicts of interest is the
[constant](https://enjoythedisruption.com/post/76944284192/neylon-highlights-another-misleading-survey-this-one)
[struggle](https://blogs.ch.cam.ac.uk/pmr/2014/03/09/elsevier-are-still-charging-thousands-of-pounds-for-cc-by-articles-immoral-unethical-maybe-even-illegal/)
for the kind of licenses attached to articles by OA journals. Clearly,
liberal re-use licenses are in the best interest of the one paying the
bills, the tax-payer. Publishers obviously do not share these interests
(neither do some authors, btw.). And so, there are constant attempts by
various publishers to gain more control over our works, even if they are
accessible for anyone to read.

These recent events have triggered the suspicion that maybe the entire
concept of scholarly publishers is antiquated, irrespective of how open,
innovative or non-profit the publisher is. In addition to the inevitable
conflicts of interest, none of the publishers are seriously considering
all three of our intellectual outputs: code, data and texts. They are
only after our text summaries, i.e., our papers. The result being, in an
age of ever sinking costs of making digital objects public, that we
overpay publishers by so much, that no money is left for our
institutional infrastructure serving our three output modalities. Thus,
even if the conflicts of interest were not an issue, separating the
fruits of our intellectual labor not only into tens of thousands of
journals, but also into separate, non-interoperable silos for code, data
and text makes absolutely no sense at all, given today's technology and
is outright insanity given tomorrow's technology.

Conflicts of interest even for ‘good’ scholarly publishers

Do you remember the
[RWA](https://en.wikipedia.org/wiki/Research_Works_Act)? It was a
[no-brainer](http://blogarchive.brembs.net/comment-n826.html) [already
back then](http://blogarchive.brembs.net/comment-n840.html) that the 40k
that Elsevier spent was well-invested: for months, Open Access activists
were busy derailing this legislation, leading a virtual standstill on
all other fronts. now, just over two years later, two Republican
representatives introduced the Frontiers in Innovation, Research,
Science and Technology (FIRST) Act. According to
[SPARC](https://sparc.arl.org/news/advocacy/first/pr):

> This provision would impose significant barriers to the public's
> ability to access the results of taxpayer-funded research.  Section
> 303 of the bill would undercut the ability of federal agencies to
> effectively implement the widely supported [White House Directive on
> Public Access to the Results of Federally Funded
> Research](https://www.whitehouse.gov/sites/default/files/microsites/ostp/ostp_public_access_memo_2013.pdf) and
> undermine the successful public access program pioneered by the
> National Institutes of Health (NIH) -- recently expanded through the
> FY14 Omnibus Appropriations Act to include the Departments Labor,
> Education and Health and Human Services.

The two sponsors of the Bill are Chairman Lamar Smith (R-TX) and Rep.
Larry Bucshon (R-IN). Not surprisingly, both sponsors are backed up by
publisher funding: Lamar Smith receives annual contributions from
[Elsevier and other
publishers](https://data.influenceexplorer.com/contributions/#Y29udHJpYnV0b3JfaW5kdXN0cnk9QjAxJTJDJnJlY2lwaWVudF9mdD1MYW1hciUyMFNtaXRoJmdlbmVyYWxfdHJhbnNhY3Rpb25fdHlwZT1hbGw=).
Both sponsors received

from a large number of scholarly (primarily medical) associations that
also publish their own subscription journals. Some of these
contributions were on the order of several tens of thousands of dollars.

Of course, nobody knows how much influence their contributions bought
these contributors, but this short list already reads like a who's who
of corporate publishers with a track record of lobbying against public
access to public research. One cannot exclude that it is a pure
coincidence that these two politicians with a track record of publisher
contributions are now drafting a publisher-friendly legislation -- and
thereby doing the public a disservice.

FIRST: the Research Works Act all over again

The recent call for a [GlamMag
boycott](https://www.theguardian.com/science/2013/dec/09/nobel-winner-boycott-science-journals)
by Nobel laureate Randy Shekman made a lot of headlines, but will likely
have no effect whatsoever. For one, the call for boycott isn't even
close in scale to "[the cost of
knowledge](https://thecostofknowledge.com/)" boycott against Elsevier
and even that drew less than 15,000 measly signatures, a drop in the
bucket with [970,000](https://www.elsevier.com/about/at-a-glance) board
members, reviewers and authors working for Elsevier largely for free.
Any boycott movement that fails to reach 500,000 signatures is an abject
failure. Moreover, even if he had half a million signatures on the
GlamMag boycott, it would also be a drop in the bucket, as probably more
than ten times as many scientists would simply see their chances of
getting a GlamMag publication increase and try even harder to publish
there. Furthermore, Shekman only pleaded to ethical sentiments, when
it's quite apparent that such pleas will fall on deaf ears if
livelihoods are at stake -- which they are as GlamMag publications are
perceived to put careers on entire different levels. Shekman failed to
base any of his arguments in data and evidence, [of which there is
plenty](https://www.frontiersin.org/Human_Neuroscience/10.3389/fnhum.2013.00291/full),
and so his pleas will likely fade unheeded. And as if all this wasn't
enough to lose confidence in the effectiveness of this boycott, there is
the obvious conflict of interest with Shekman, as the editor-in-chief of
another "luxury journal" pleading for his colleagues to leave the legacy
"luxury journals" to publish their work where -- in Shekman's
self-professed "luxury journal" eLife?

Devoid of evidence and replete with conflict of interest and at least
perceived
[hypocrisy](https://biomickwatson.wordpress.com/2013/12/10/i-think-you-might-be-a-hypocrite/),
as much as I'd want it to be successful, I fear this was the first and
last time we heard of this boycott.

Nevertheless, this is just the last in a row of different calls to
collective action to show the Evilseviers of science publishing who's
boss over the last decade or so. Moreover, new publishing venues are
springing up all over the place and scientists are flocking to them with
their publications. The media are picking up on the momentum that
publishing reform is currently garnering and increasing. It really does
seem as if there is now, after more than a decade, something actually
shifting in academic publishing.

In the string of public action, campaigns and stunts, one thing was
notably missing: a call to boycott where it would really hurt
publishers: cutting subscriptions. The only thing close to this was the
threat of [boycotting Nature Publishing
Group](http://blogarchive.brembs.net/comment-n617.html) by the
University of California system in 2010. That never happened essentially
because NPG caved in. Such a boycott, if actually enacted, would
certainly put the spotlight on publishing reform as it would get several
stakeholders moving at once:

- Publishers would feel the pinch not in their public image, but in
  their balances
- Scientists would consider twice to publish in a journal that hardly
  anybody can read
- Given the high cost of subscriptions, huge funds would be freed in the
  institutions to develop a digital infrastructure that would make
  publishers obsolete and save a pretty penny along the way
- An effective boycott of the most expensive publishers would also drive
  down subscription costs in the remaining corporations as they compete
  for the remaining subscription funds
- If such a boycott went into effect, it would actually constitute a
  significant short-term sacrifice to researchers who would have even
  more trouble reading some of their literature for a certain period of
  time, sending an even stronger signal of resolve than some 30k
  signatures on a website

However, I project that such campaigns are unlikely to find much
support, as it would require libraries and their faculty to actually sit
down on the same table and defend their common institutions. Why does
something so seemingly easy have to be so difficult?


[Sven Fund](https://www.cxi-konferenz.org/fund/){target="_blank"}, CEO
of the German publishing house [de
Gruyter](https://www.degruyter.com/){target="_blank"} was recently
[interviewed](https://poynder.blogspot.de/2013/09/de-gruyters-sven-fund-on-state-of-open.html){target="_blank"}
by Richard Poynder in his widely read interview series on open access.
In the interview, he first avoided answering the question if de Gruyter
had ever lobbied against open access. However, in a later correspondence
with Richard Poynder, he made unambiguously clear:

> "Just for the record: No, De Gruyter has never lobbied against OA."

Now, this statement seems somewhat surprising, as [de Gruyter is a
member](https://www.boersenverein.de/de/portal/Mitgliedersuche/158377?suchstring=gruyter&plz=&lv=){target="_blank"}
of the "Börsenverein des Deutschen Buchhandels", the trade organization
of publishers in Germany. This organization [states
itself](https://www.boersenverein.de/de/404789){target="_blank"} that it
"accompanies the recent legislative reforms with intense lobbying" (own
translation). In other words, de Gruyter may not have a "Vice President
of [Government
Relations](https://en.wikipedia.org/wiki/Government_relations){target="_blank"}"
as Elsevier has in [Angelika
Lex](https://www.bg.pw.edu.pl/iatul2011/proceedings/b/Lex_A.pdf){target="_blank"},
but it is a paying member of the one organization that does the
lobbying. The kind of changes the German publishers would like to see in
this legislation is [quite
obvious](https://www.boersenverein.de/de/portal/index.html?meldung_id=624387){target="_blank"}:
"a right to second publication [\[i.e., in green open access
repositories\]]{style="color: #ff0000;"} carries no benefits and will
cost the tax-payer money that is dearly needed in research and
elsewhere" (my loose translation).

So, has de Gruyter not obviously paid their own trade organization to
lobby against open access? Does Mr. Fund think we cannot enter
\[börsenverein "open access"\] into a search engine and just click on
the first two links that come up? This is a prime example of the raised
middle finger publishers have been prominently presenting towards
academia at large for the last decade. Why should anyone ever deal with
organizations like this again?

In a few weeks, on October 10, I'll be on a
[panel](https://www.bib-info.de/verband/projekte/kooperation-frankfurter-buchmesse/buchmesse-2013.html){target="_blank"}
with Mr. Fund at the Frankfurt Book Fair. We'll see if these obscene
gestures of publishers towards academics become a topic of the
discussion.

**UPDATE**: Since I commented on the interview, Mr. Fund has
[replied](https://poynder.blogspot.co.uk/2013/09/de-gruyters-sven-fund-on-state-of-open.html?showComment=1379927607223#c358803342636429177).
However, he does not apologize for an oversight when he forgot that his
company was a member of an organization (perhaps also other
organizations) that actively and intensely lobby against open access.
Nor does he indicate that he considers canceling the membership with
this organization, nor is there apparently any public record that he
even disagrees with the anti-OA lobbying efforts of the Börsenverein.
Instead, he writes that we should ask the management of the
Börsenverein, whether he disagrees with them or not. Thank you, Mr. Fund
for proving my point. I rest my case.

**UPDATE 2**: Not only does the Börsenverein lobby intensely against
open access, on occasion of these lobbying efforts on [November 15,
2004](https://www.isn-oldenburg.de/~hilf/vortraege/iuk05/iuk05-all.html),
the corporate counsel of the Börsenverein, [Christian
Sprang](https://www.boersenverein.de/de/186978), was
[recorded](https://www.isn-oldenburg.de/~hilf/vortraege/iuk05/iuk05-5.html)
as saying: "scientists are our natural enemies". So Fund's company
supports an organization that sees scientists as their enemies.
