The trinity of failures

According to a recent study, employee surveillance is rampant in today’s corporate work environment. This study documents how, often under the pretense of cybersecurity or risk analysis (sort of like academic publishers, actually), companies analyze the behavioral data they collect from their employees to help them make “evidence-led”, i.e., algorithmic employment decisions.

Flashback: The neurobiology of self-learning

This morning I was reminded of the age of some of the technology we’re using. Hyperlinks were developed at Stanford University and first demonstrated by their inventor Douglas Engelbart (using the first mouse) in 1968:  On Tuesday, Douglas Engelbart died, even before the scholarly literature was able to fully implement the technology he invented, 45 years and counting.

The recent publication of the “Ten Principles of Plan S” has sparked numerous discussions among which one of several recurring themes was academic freedom. The cause for these discussions is the insistence of the funders supporting Plan S that their grant recipients only publish in certain venues under certain liberal licensing schemes.

Does academic freedom entail exemption from spending rules?

Over the last ten years, scientific funding agencies across the globe have implemented policies which force their grant recipients to behave in a compliant way. For instance, the NIH OA policy mandates that research articles describing research they funded must be available via PubMedCentral within 12 months of publication. Other funders and also some institutions have implemented various policies with similar mandates.

Arguably, there is little that could be more decisive for the career of a scientist than publishing a paper in one of the most high-profile journals such as

. After all, in this competitive and highly specialized days, where a scientist is published all too often is more important than what they have published.

How Nature Magazine consistently prefers anecdote over data

The recent call for a GlamMag boycott by Nobel laureate Randy Shekman made a lot of headlines, but will likely have no effect whatsoever. For one, the call for boycott isn’t even close in scale to “the cost of knowledge” boycott against Elsevier and even that drew less than 15,000 measly signatures, a drop in the bucket with 970,000 board members, reviewers and authors working for Elsevier largely for free.

In the last “Science Weekly” podcast from the Guardian, the topic was retractions.  At about 20:29 into the episode, Hannah Devlin asked, whether the reason ‘top’ journals retract more articles may be because of increased scrutiny there. The underlying assumption is very reasonable, as many more eyes see each paper in such journals and the motivation to shoot down such high-profile papers might also be higher.

There are those who demand journal peer-review be paid extra on top of academic salaries. Let’s have a look at the financials of that proposal. The article linked above confirms common rates of academic consulting fees, i.e., anything between US$100 per hour for graduate students and US$350 per hour for faculty. Taking a conservative US$200 as an easy, lower-bound estimate for, say, a post-doc hour seems to cover most cases.

No matter how well-intended (and we all know to which place the road leads that is paved with good intentions!), transformative agreements (such as DEAL in Germany) are generally the wrong tool at the wrong time for making publicly funded science accessible to the public.

Booming university administrations

I really loathe reviewing for GlamMagz for two main reasons. For one, it’s hard to remain neutral: publication of a paper in my field in such a journal is beneficial both for the field and for the young people who are authors on this paper. Second, the demands of some of my colleagues so often make my blood boil. At that point I’m very happy these reviews are anonymous and I really don’t want to know the names of these colleagues.

Figures and legends occupy one virtual desktop and the text another. In this way, I can actually review on-screen, but it is one heck of a work-around and by no means convenient.

published a news story (not a peer-reviewed paper) by Gonzo-Scientist John Bohannon on a sting operation in which a journalist submitted a bogus manuscript to 304 open access journals (observe that no toll access control group was used).

For our course this year I was planning a standard neurogenetic experiment. I hadn’t ever done this experiment in a course, yet, just two weeks ago I tried it once myself, with an N=1. The students would get two groups of

Whither now, Open Access?

On May 23, the Council of the EU adopted a set of conclusions on scholarly publishing that, if followed through, would spell the end for academic publishers and scholarly journals as we know them. The content was simple enough: Bohannon picked a swath of largely fake journals, submitted fake manuscripts and boasted that more than 60% of his submissions were accepted.

In our new lab here in Regensburg, we are currently re-establishing the method of confocal microscopy. To start with, we used the fly lines which show a defect in the temporal structure of their spontaneous behavior (a project of one of our graduate students). this fly line uses two transgenic constructs (c105 and c232) to drive expression in specified neurons in the fly brain, i.e., the merged expression patterns of c105 and c232.

Looking for a PhD student

There have been many discussions about the march for science, pro and con. Some of them have made me doubt the utility of the march, some have made me fear unintended consequences, again others seemed tangential and petty. In these past months, I have struggled to articulate my own reasons why I feel the urge to march for science. Today, I start to see two main reasons to march for science.

This is an easy calculation: for each subscription article, we pay on average US$5000. A publicly accessible article in one of SciELO’s 900 journals costs only US$90 on average. Subtracting about 35% in publisher profits, the remaining difference between legacy and SciELO costs amount to US$3160 per article.

Over the last few months, there has been a lot of talk about so-called “predatory publishers”, i.e., those corporations which publish journals, some or all of  which purport to peer-review submitted articles, but publish articles for a fee without actual peer-review. The origin of the discussion can be traced to a list of such publishers hosted by librarian Jeffrey Beall.

The debate over how publishers use the large "non-publication costs"
(Fig. 1) that they incur and academic libraries, mainly, are funding has
been going on for some time now. Above and beyond the cost items we
discuss in our [paper on publication
costs](https://f1000research.com/articles/10-20/v2), it has been
established that [investments in surveillance
technology](https://bjoern.brembs.net/2021/09/algorithmic-employment-decisions-in-academia/)
are also part of the publisher spending academic libraries are
financing. In an informal brief generated by the German
[GFF](https://freiheitsrechte.org/english/), the legal expert who
authored it describes a situation with clear indications that one cost
item which we discuss in the paper has been particularly detrimental for
the scholarly community and the tax payer: lobbyism.

Even before Franz Inglefinger coined his [eponymous
rule](https://en.wikipedia.org/wiki/Ingelfinger_rule) that every
scholarly article must only be published in a single journal, have
scholarly journals been a collection of monopolies. Every article is
only available at a single source and so there is no market and no
competition. This lack of substitutability has not only been the main
reason for exempting subscriptions of scholarly journals from
procurement rules ("single/sole source exemption"), but of course also
behind the supra-inflationary price rises to the detriment of the tax
payer funding public research and teaching institutions (Fig. 2).

When the late Jon Tennant and I filed our [formal complaint to the
European Commission](https://doi.org/10.5281/zenodo.1472044) in 2018, in
which we detailed how scholarly journal publishing was not a market but
a collection of small monopolies, we had no idea that the EC was already
well aware of that fact and saw nothing wrong with it. In fact, their
reply at the time surprised us, when it indicated that the EC concurred
with our description of scholarly journals being collections of
monopolies, but saw levers for regulation/mitigation elsewhere.

Today, I have been privy to the informal brief written by a legal expert
of the GFF mentioned above. It cites two prior EC instances from
[2003](https://ec.europa.eu/competition/mergers/cases/decisions/m3197_en.pdf)
and
[2015](https://ec.europa.eu/competition/mergers/cases/decisions/m7476_20150331_20310_4221794_EN.pdf)
where the EC had already acknowledged the lack of a genuine market due
to the lack of substitutability (the reply to our complaint is thus just
one in a long list of such documents acknowledging the lack of
competition in scholarly publishing). In these documents, the EC writes,
for instance:

> In particular, from a demand-side point of view, it is rare that two
> different publications can be viewed as perfect substitutes, as there
> are differences in the coverage, comprehensiveness and content
> provided. Therefore, in terms of functional interchangeability, two
> different publications could hardly be regarded as substitutable by
> the end-users, the readers. On that basis, the Commission found that
> consumers will rarely substitute one publication for another following
> a change in their relative prices

and

> Publications for different academic subjects are clearly not
> substitutable from the reader's point of view. Even within a given
> discipline, there may be little demand side substitution from the
> point of view of the individual academic between different
> publications.

and

> In this case, a strict demand approach would lead to the definition of
> a multitude of relevant markets of imprecise boundaries and small
> dimensions.

"Small dimension" of course meaning that every article would constitute
its own market. The term "demand-side" here is defined as both readers,
i.e., academics as well as the institutions paying for the journals,
i.e., libraries, while "supply-side" refers to the publishers:

> The results of the market investigation in the present case confirmed
> the relevance of supply-side considerations for the definition of the
> relevant product market in the academic publishing sector.
> Publications in different academic subjects are indeed not
> substitutable from the readers' perspective. However, many academic
> publishers appear to be active across most of the possible
> segmentations of the market, and offer publications covering several
> disciplines

The quote here is an example of how the EC is well aware of the
conflicting interests between readers and libraries on the one hand
(demand-side) and publishers (supply-side) on the other, while at the
same time expressing a clear prioritization ("confirmed the relevance")
of the interests of the supply-side over the interests of the
demand-side. The dysfunctionality of the current situation for readers
and libraries is understood, acknowledged and dismissed by the EC as
"not relevant" -- very similar to the reply we received for our formal
complaint. In this particular quote, a fig-leaf is offered by stating
that the big publishers cover many scholarly fields, leading to each
library having contracts with several publishers, giving the superficial
impression that there would be several suppliers in a "supply-side"
market. The sentence just prior, however, makes it clear that this is,
in fact, not really a genuine market, but one that exists only on paper,
solely for regulatory purposes.

The GFF legal expert expressed his assessment that courts would be
unlikely to challenge these EC market definitions as the definitions are
seen as the lesser of two evils: explicit confirmation of the publisher
monopolies would entail the loss of the market and with it loss of
regulatory power. In other words, if the publishers were not operating
within a market, they would also not be subject to regulatory market
oversight. The consequence would be completely unregulated mergers
between the most dominant players, which is seen as worse than the
status quo.

His assessment is not changed by the "single source exemption" from
procurement rules: as these rules and anti-trust regulations are
separate jurisdictions, the fact that spending rules define academic
publishers as monopolists while according to anti-trust regulators they
are not, may be a logical contradiction, but not a legal one.

Thus, there are multiple reasons why the EC chose to merely acknowledge
the interests of the scholarly community and instead define markets from
the perspective of publishers. At this point, it is impossible to tell
how much each reason has influenced the authors of these documents. It
may not even be all that important to find this out in order to inform
the scholarly community on the implications from this legal assessment.
As I see it, there are two main lessons to be drawn from this legal
analysis:

1. If the scholarly community strives to achieve a genuine publishing
 market with competition, we have to design it ourselves. Politicians
 or other decision-makers outside of scholarship will not perform
 this task for us. There is not going to be any help from outside. In
 the lack of a clear market alternative, regulators prefer a group of
 relatively small monopolists over few large or even a single
 monopolist. The scholarly community is the only actor who can
 provide this missing alternative.
2. Among the "non-publication costs" is a sizeable chunk of money that
 is being used in various legislatives around this globe to convince
 legislators and regulatory bodies that the interests of the academic
 publishing corporations outweigh the interests of the tax payer.
 This constitutes yet another example of how the scholarly community
 provides funds to publishers which then get used against the
 interests of the scholarly community.

From these lessons follows a clear strategic way forward: if the
scholarly community wants to escape from the parasitic relationship with
these corporations, it needs to create a genuine market alternative such
that regulators need not fear the complete loss of market regulations.
Luckily, there [now are ways to create such a
market](https://doi.org/10.5281/zenodo.5526634) and it is fully within
the powers of the scholarly community to create it on its own. For this
market to become a market of service providers, the scholarly content
needs to come back under the control of the scholarly community. Once
this market exists, the scholarly community must lobby at the relevant
bodies to ensure both that "demand-side" interests receive at least the
same "relevance" as "supply side" interests and that the "single source
exemption" from procurement rules is annulled for scholarly publishers.

Do you remember the

[no-brainer](http://blogarchive.brembs.net/comment-n826.html) [already
back then](http://blogarchive.brembs.net/comment-n840.html) that the 40k
that Elsevier spent was well-invested: for months, Open Access activists
were busy derailing this legislation, leading a virtual standstill on
all other fronts. now, just over two years later, two Republican
representatives introduced the Frontiers in Innovation, Research,
Science and Technology (FIRST) Act. According to
[SPARC](https://sparc.arl.org/news/advocacy/first/pr):

> This provision would impose significant barriers to the public's
> ability to access the results of taxpayer-funded research.  Section
> 303 of the bill would undercut the ability of federal agencies to
> effectively implement the widely supported [White House Directive on
> Public Access to the Results of Federally Funded
> Research](https://www.whitehouse.gov/sites/default/files/microsites/ostp/ostp_public_access_memo_2013.pdf) and
> undermine the successful public access program pioneered by the
> National Institutes of Health (NIH) -- recently expanded through the
> FY14 Omnibus Appropriations Act to include the Departments Labor,
> Education and Health and Human Services.

The two sponsors of the Bill are Chairman Lamar Smith (R-TX) and Rep.
Larry Bucshon (R-IN). Not surprisingly, both sponsors are backed up by
publisher funding: Lamar Smith receives annual contributions from
[Elsevier and other
publishers](https://data.influenceexplorer.com/contributions/#Y29udHJpYnV0b3JfaW5kdXN0cnk9QjAxJTJDJnJlY2lwaWVudF9mdD1MYW1hciUyMFNtaXRoJmdlbmVyYWxfdHJhbnNhY3Rpb25fdHlwZT1hbGw=).
Both sponsors received
[contributions](https://data.influenceexplorer.com/contributions/#Y29udHJpYnV0b3JfaW5kdXN0cnk9SDAxJTJDJnJlY2lwaWVudF9mdD1MYXJyeSUyMEQuJTIwQnVjc2hvbiZnZW5lcmFsX3RyYW5zYWN0aW9uX3R5cGU9YWxs)
from a large number of scholarly (primarily medical) associations that
also publish their own subscription journals. Some of these
contributions were on the order of several tens of thousands of dollars.

Of course, nobody knows how much influence their contributions bought
these contributors, but this short list already reads like a who's who
of corporate publishers with a track record of lobbying against public
access to public research. One cannot exclude that it is a pure
coincidence that these two politicians with a track record of publisher
contributions are now drafting a publisher-friendly legislation -- and
thereby doing the public a disservice.
