When rightsholders claim content that does not belong to them, it is called Copyfraud or Overclaiming. There is already a danger that the enforcement of both copyright and its exceptions will be left in the hands of internet platforms. Member states should use the implementation of the EU copyright directive for a much needed course correction.

With the planned obligation for internet platforms to obtain licences, the EU Copyright Directive harms the balance in copyright law, says law professor Martin Kretschmer. In his opinion it is unworkable. In any case, the European Court of Justice will soon make certain internet platforms liable for copyright infringements.
